Hotel Purbani Land issue

 For the longest time ever, we have been under the impression that the land on which the hotel is built on was purchased by our father. This has been incorrect. 

Former DIT (Dhaka Improvement Trust), now RAJUK (Rajdhani Unnoyon Kortripokho) did not and does not sell land that belongs to it. They are only leased out on 99-year leaseholds.


LEASEHOLD PROPERTY

RAJUK (Capital Development Authority) is the only governing body responsible for the urbanization of Dhaka. The properties under RAJUK are actually called leasehold properties. In fact, no land or plot under the supervision of RAJUK is sold you can only lease it for 100 years, hence the name. In other words, buying RAJUK property does not mean buying it for life, but leasing it for 100 years. It is mandatory to obtain prior approval and permission for any kind of purchase, sale, or construction of such properties. If the property is under the supervision of RAJUK, then it must be a leasehold property.

Rajuk Leasehold

Hotel Purbani land was allotted by DIT to our father and therefore we are the inheritors of the lease.Being leaseholders evidently gives us the right to TRANSFER the Lease to a buyer of the lease upon a approval of  Rajuk. The legal process requires  the submission of our succession certifcate to Rajuk to undergo the process known as MUTATION which would then allow for the legal transfer to another party.

Simply put, the new leaseholder would then be in a position to give eviction notice to the current businesses occupying the buildings.

This would create the circumstaces needed to force the illegal occupants of Hotel Purbani to come to a settlement with our family which has been deprived of all incomes and rental  benefits of the property.

Whether or not this becomes reality remains to be seen.
